Key Facts: Criteo's entire business model is cross-publisher behavioural retargeting: it tracks users across partner websites, builds purchase-behaviour profiles, and serves personalised retargeting ads — a textbook own-advertising-profiling operation. CNIL fined Criteo €40 million (Jun 2023) for five GDPR violations: failure to verify valid consent, insufficient transparency, failure to respond to data access requests, failure to honour erasure requests, and inadequate joint-controller arrangements. The Conseil d'État (France's highest administrative court) upheld the fine in full (Mar 2026). Amsterdam District Court ordered Criteo to cease use of third-party cookies.
