Key Facts: Pinterest profiles users for personalised advertising by default, relying on legitimate interest as its legal basis. Following the CJEU ruling in C-252/21 (Bundeskartellamt, Jul 2023), legitimate interest cannot justify personalised advertising profiling. NOYB filed a GDPR complaint with French CNIL (Oct 2024) directly invoking this CJEU ruling, arguing Pinterest's advertising LI basis is invalid. NOYB additionally found Pinterest failed to respond adequately to data access requests (Art. 15 GDPR). Pinterest Europe Ltd. (Dublin) is EEA controller; data processed in the US.
